FORMAL STATEMENT OF POSITION AND STEWARDSHIP
By K. Kirton Niner (Shimmer)
This statement is made in reference to an ongoing matter involving my 2.5-acre property in Rancho del Oro, which I have continuously stewarded with care, respect, and intention since taking residence.
I affirm the following:
I am the steward of a whole, undivided parcel of land. This land is not only a legal holding, but a living environment—home to natural Sonoran desert growth, long-standing elements of the earth, and personal property representing years of memory, family life, and preservation.
At no time have I granted permission for any ব্যক্তি or neighboring party to:
- Enter upon my property for the purpose of access
- Alter, remove, or destroy natural or personal elements on the land
- Establish any pattern of use that would constitute a right or claim
Any such actions taken have been unauthorized, objected to, and documented.
There exists an established right-of-way providing access where appropriate. There is no necessity—legal or practical—for any party to cross or utilize my land beyond that boundary. Emergency access to neighboring properties is not dependent on the use of my parcel.
Despite this, there have been repeated actions involving:
- Trespass
- Destruction of natural Sonoran desert vegetation
- Removal of long-standing natural features
- Disposal and damage of personal property of irreplaceable sentimental value
These actions have not only impacted the physical land but have disturbed the peace, integrity, and balance of the environment I have maintained.
I reject any attempt to convert unauthorized use into a legal right through claims such as prescriptive easement. Such claims do not reflect the reality of this situation, as use has neither been permitted nor uncontested.
I remain committed to:
- Upholding the integrity of my property
- Maintaining peace without surrendering boundaries
- Allowing proper legal and governing authorities to review and address these matters according to Law
I do not consent to the rewriting of my story, my land, or my stewardship by others.
What I have built, preserved, and lived upon is not available for claim by those who did not tend it.
I stand in truth, in peace, and in rightful stewardship of what is mine.
Signed,
K. Kirton Niner
