INTRODUCTION

My name is K. Kirton Niner.
I am the Wife of a private landowner and Mother living in unincorporated Maricopa County, Arizona.

I am submitting this report to request investigation into systemic failures of enforcement and accountability involving private property rights, trespass, theft, destruction of land, and a separate historical matter involving interference with my child shortly before adulthood.

These are two distinct issues, but they reveal a common pattern: when ordinary citizens follow the Law, act in good faith, and comply with government processes, they are not being protected.


PART ONE: PRIVATE PROPERTY & LAND DESTRUCTION (CURRENT ISSUE)

Verified Property Facts

In 2017, my husband and I purchased a 2.5-acre patented parcel of land.

After confirming the patent status, we proactively worked with Maricopa County to ensure the land was properly recognized and assessed. We paid increased property taxes specifically so that any disputes could be handled correctly and transparently within county systems.

We did everything we were supposed to do as responsible property owners.


What Is Happening

Despite this, neighboring individuals to the north—who live on their own, separate parcels of a split U.S. Patent Property—have repeatedly:

  • Entered our property without permission
  • Removed or destroyed trees and vegetation
  • Taken, discarded, or destroyed personal property
  • Altered land features, causing damage and erosion
  • Thrown away items that cannot be replaced

These actions were unauthorized, deliberate, and repeated.

No one has the right to walk onto another person’s land, remove trees, destroy property, or decide what stays and what goes.


Failure of Enforcement

When these incidents were reported, law enforcement and county departments repeatedly declined to act, labeling them as “civil matters,” even though:

  • Trespass is a crime
  • Vandalism is a crime
  • Theft and destruction of property are crimes

This failure to enforce the Law has emboldened further violations and left us unprotected on land we lawfully own and maintain.


Why This Is a Consumer & Public Issue

This raises serious questions:

  • What does property ownership mean if the Law is not enforced?
  • Why are citizens who comply with regulations and pay higher taxes left without protection?
  • At what point does government inaction become tacit permission?

If this can happen to one compliant landowner, it can happen to anyone.


PART TWO: SEPARATE HISTORICAL MATTER — CHILD & INFLUENCE (BACKGROUND ISSUE)

This issue is not connected to the current neighbors or land dispute, but it provides important context regarding institutional failure to protect.

Eight weeks before my son turned eighteen, a registered federal lobbyist attempted to interfere in my family’s legal affairs and pursued control over my child.

This matter occurred years ago and is distinct from the current property violations. However, it demonstrates a troubling pattern: when power, status, or influence is involved, systems that are supposed to protect families and children often fail to act decisively.

That experience informs my concern today—not emotionally, but factually.


COMMON THREAD: FAILURE OF ACCOUNTABILITY

In both situations—one involving my child, the other involving my land—the same issue appears:

  • Clear boundaries were ignored
  • Lawful authority was undermined
  • Responsibility was deflected instead of enforced

As a Mother, a landowner, and a citizen, I am not asking for special treatment.
I am asking for equal treatment under the Law.


REQUEST FOR INVESTIGATION

I am requesting that ABC Consumer Reports investigate:

  • Whether Maricopa County’s enforcement practices are failing property owners
  • Whether repeated inaction enables trespass, vandalism, and theft
  • Whether citizens who comply with the Law are being denied meaningful protection

I have documentation, photographs, call logs, records, and historical files available upon request.


CLOSING

This is about accountability, boundaries, and whether the Law still applies equally.

No one should lose their land, their property, or their child’s safety because systems refuse to act.
