Our names are Corey J. Niner and K. Kirton Niner (CK KIRTON-NINER). We appear before this mediation seeking a peaceful and lasting resolution to an ongoing dispute affecting our family, our home, and our property.
We wish to begin by explaining that our position is not motivated by hostility toward our neighbors. Our position is rooted in stewardship, preservation, respect for boundaries, and respect for the history of the land entrusted to our family.
The property at issue traces its history to a United States land patent. Long before later lot splits, subdivisions, utility installations, and modern development occurred, this land existed as part of a larger historical framework of settlement and private ownership. We honor that history.
We also honor the veterans whose service helped preserve the freedoms, property rights, and self-governance that Americans enjoy. This is not an abstract principle to us. It is personal. Members of our family, including fathers, brothers, uncles, and grandfathers, served our country. Their example taught us that rights carry responsibilities and that stewardship requires both care and courage.
We further recognize the generations who came before us and the generations who will follow us. We do not view ourselves merely as owners of this property. We view ourselves as stewards entrusted with its care, preservation, and improvement for the benefit of our family and those who come after us.
Together, we have invested years of labor, research, maintenance, restoration, and development into this property. We have worked to understand its history, preserve its character, improve its condition, and maintain it as our family home. We have planted, repaired, restored, documented, and cared for this land because we believe stewardship is measured not only by what we receive, but by what we leave behind.
Our goal is simple. We seek clear boundaries, peaceful coexistence, and respect for property rights.
We do not seek authority over any neighboring property. We do not seek to direct another property owner’s use, development, access, utilities, improvements, or decisions. Likewise, we ask that neighboring parties exercise no authority over ours.
We do not consent to neighboring parties entering, using, altering, directing, controlling, or claiming any portion of our property. We seek a resolution that clearly establishes and respects the boundaries between our properties so that all parties may move forward independently and without future conflict.
This matter is about more than lines on a map. It is about the principle that each property owner should be responsible for their own property and should respect the rights and boundaries of others. It is about preserving peace by establishing certainty.
Over the years, when faced with conflict, we have chosen stewardship. Where there have been disputes, we have chosen preservation. Where there have been scars upon the landscape, we have chosen restoration. We continue to care for this property because we believe our responsibility is not only to ourselves, but also to the generations that follow us.
Our request is straightforward: that property rights be respected, boundaries be honored, and all parties be allowed to peacefully enjoy and manage their own land without interference from one another.
We are asking for a solution that brings finality, clarity, and peace. We believe the most lasting resolution is one that respects history, honors the law, protects established property rights, and allows each household to move forward independently.
